SCOPE

The position of Senior Counsel, Environmental and Safety,will report to the Senior Assistant General Counsel for Global Environment andSafety.The position will be based atthe headquarters of Praxair/Linde plc in Danbury, Connecticut. Senior Counselwill be responsible for providing regulatory compliance assistance and legaladvice to a wide range of businesses worldwide.The primary area of responsibility will be in the U.S., but the positionwill also assist the Safety Health Environment and Quality (SHEQ) group in monitoringinternational regulations and advising on major capital projects.This role also provides support to ourCorporate Real Estate group.

KEYACCOUNTABILITIES:

  • Monitor federal laws and regulations and advisebusiness on significant permit and other regulatory compliance issues

  • Defend environmental or safety complianceenforcement actions or litigation brought against the company by governmentagencies or private parties

  • Advise on environmental due diligence andnegotiate environmental contract terms in major commercial or real estatetransactions

  • Review and advise on environmental and safetyliabilities associated with major capital projects

  • Provide legal counsel on Superfund matters andcost recovery actions associated with remediation of properties

  • Work with SHEQ teams to investigate and reporton environmental and safety incidents, review and comment on SHEQ policies,programs and communication

  • Assist in reporting for corporatesustainability report and related initiatives

  • Provide practical guidance and legal advice tothe U.S. Real Estate Group to include: providing legal assistance in connectionwith environmental matters, drafting and negotiating purchase and saleagreements and commercial leases and subleases

  • Knowledge of relevant laws and regulationsassociated with the position to include: Clean Air Act, Clean Water Act, RCRA,CERCLA, Oil Pollution Act, TSCA, FIFRA, OSHA Process Safety Managementstandard, EPA Risk Management Plan program, DOT/PHMSA pipeline and vehicleregulations, OSHA standards under 29 U.S.C 1910, and equivalent state environmentaland safety regulations

Qualifications

QUALIFICATIONS:

  • Bachelor’s degree and a law degree from anaccredited and nationally recognized institution

  • Minimum of 10 years’ legal experience requiredin the practice of environmental, health and safety law, preferably involvingthe chemical and/or petroleum industries, as well as prior real estateexperience

  • The successful candidate will have a goodworking knowledge of U.S. environmental regulations, permitting and complianceenforcement matters, experience in environmental due diligence and remediationprojects, as well as real estate transactions and commercial leasing matters

  • As it relates to safety, the candidate shouldhave some experience in the U.S. handling personnel safety and process safetyregulatory issues and OSHA inspections and enforcement

  • Prior international experience is not requiredbut preferred

  • Client counseling experience is critical

  • Excellent communication and writing skills areessential

  • Abilityto workindependently, andcollaborate with other members of the lawdepartment, subject matter experts, and business leaders
